1. Introduction Welcome to FABIO AZUR Photography. These Terms and Conditions govern your use of our website (www.fabioazur.com) and the booking of our photography services. By accessing our website or securing our services, you agree to be bound by these terms.
2. Copyright and Intellectual Property All photographs, text, graphics, and design elements on this website are the exclusive intellectual property of FABIO AZUR Photography and are protected by international copyright laws.
For Clients: Upon final delivery of your wedding gallery, you are granted a personal, non-commercial print release. This allows you to print and share your images with friends and family. However, FABIO AZUR retains the original copyright.
Image Alteration: To preserve the integrity of our Fine Art aesthetic, clients and third parties are strictly prohibited from altering, re-editing, or applying filters to the final delivered images.
3. Bookings, Retainers, and Payments To secure FABIO AZUR for your wedding date, a signed contract and a non-refundable retainer fee are required.
Your date is not reserved until both the retainer and the signed agreement are received.
The remaining balance is due exactly as outlined in your personalized contract (typically 30 days prior to the wedding date).
Prices and collections are subject to change without notice, but securing your date guarantees the rates agreed upon at the time of booking.
4. Artistic Vision and Delivery You are hiring FABIO AZUR for our distinct editorial, fine art style.
Editing Process: All images are individually edited to reflect our signature aesthetic. We do not provide unedited RAW files under any circumstances, as they represent an unfinished product that does not reflect our brand standards.
Gallery Delivery: The final curated selection of images will be delivered via a private online gallery within the timeframe specified in your contract (usually 8 to 12 weeks, depending on the season).
5. Cancellations and Rescheduling If you need to cancel or reschedule your wedding, you must notify us in writing as soon as possible.
Retainers are non-refundable, as they guarantee our availability and result in the turning away of other potential clients for your date.
If you reschedule, we will make every effort to accommodate your new date, subject to our availability. A new contract and a rescheduling fee may apply.
6. Limitation of Liability and Force Majeure While we take the utmost care with your memories, FABIO AZUR Photography cannot be held liable for photographic failures caused by circumstances beyond our control. This includes, but is not limited to, extreme weather, severe lighting restrictions at the venue, interference from guests, or sudden equipment malfunction. In the unlikely event of severe illness, emergency, or an act of God that prevents FABIO AZUR from performing his duties, we will make every reasonable effort to secure a replacement photographer of similar style and expertise, or offer a full refund of all monies paid.
7. Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Portuguese courts.
